Gaston County, NC (WNN) - Gaston County is facing a lawsuit following allegations made by Swinerton regarding a bid submitted several weeks ago.
After Swinerton was pulled from consideration for the Health Department building renovation, the company filed a lawsuit against Gaston County. In a press release, Gaston County stated that they will "fight Swinerton's efforts to stop this critical project so that the Health Department and its partners can continue to provide essential services to the community." So what are Swinerton's allegations? Here's what happened.
At the December 9th Board of Commissioners Meeting, Commissioner David Goldberg stated that multiple bids had been submitted for the Health Department building renovation. While Swinerton Building was the lowest bid, Gaston County noticed a "calculation error" with the base bid. After correcting this error, Swinerton ended up lowering the number in Gaston County's favor by $150,000.
However, another error was discovered in Swinerton's bid. Goldberg said they failed to acknowledge the amount of their bid that would be granted to subcontractors. He stated, "that statute is required by NC explicitly. They did not fill that blank in."
As a result, Gaston County pulled Swinerton's bid. Goldberg and other county officials said keeping the bid would not have been fair to the other bidders. This decision left Beam Construction with the lowest bid for the Health Department building renovation. Swinerton soon after filed a lawsuit on Wednesday, December 17th, implying that their bid was improperly removed from the bidding process.
In a press release Gaston County said this:
On Wednesday, December 17, 2025, Swinerton Builders filed suit against Gaston County after not being awarded a contract to renovate the Gaston County Public Health Department building. Gaston County denies the allegations in the lawsuit. All bidders were treated fairly and in accordance with the law.
While Swinerton's bid was competitive, it contained errors that the County could not waive or excuse under state law. Gaston County will fight Swinerton's effort to stop this critical project so that the Health Department and its partners can continue to provide essential services to the community.
