CHERRYVILLE, NC (WNN) – The Cherryville Police Department (CPD) has declared a Pine Street residence a nuisance and has closed the home.

According to a post from CPD’s Facebook page, the N.C. Alcohol Law Enforcement Division (ALE) Nuisance Abatement Team and CPD responded to numerous complaints by declaring the home a nuisance.ย 

Common complaints about residence include drug overdoses, drug offenses, assaults and fires. 

Under chapter 19 of the N.C. General Statute, ALE can authorize abatement of properties after investigating allegations of nuisance.

Nuisance activities are defined under the general statute as: prostitution, gambling, illegal possession or sale of drugs or alcoholic beverages, and repeated acts which create a breach of the peace. In this context, abatement is the action taken to alleviate a nuisance. 

According to Brandon Hunsucker, the Chief of CPD, his department has received over 300 calls about the residence in the past two years.

“We have made numerous arrests, we’ve been to overdoses, drug offense calls, we have made drug buys out of that home and have arrested multiple people on drug offenses out of there,” said Chief Hunsucker.ย 

Before contacting ALE for assistance, CPD gathered evidence for abatement. ALE’s investigation took two to three months to conclude.

The original owner of the property has transferred all rights to her nephew through a quick claim deed.

“The person who was living there can no longer be there” said Chief Hunsucker.

Ultimately, the intent of the abatement is to help protect the peace of a Cherryville neighborhood. With ALE’s support, CPD acted under Chapter 19 of the N.C. General Statute to address nuisance activities at the property.
